1. Agreement to Terms

By downloading, installing, or using Product Photo Studio ("the App"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this requirement.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Reverse-engineer, decompile, or modify the App

• Rent, lease, or resell access

• Use automated tools (bots, scrapers) to access the App beyond normal use

• Remove copyright or proprietary notices

4. Your Content and Intellectual Property

You Own Your Photos

You retain all rights to images you upload or capture ("Your Content").

License to Us

By using the App, you grant us a limited, worldwide, non-exclusive license to:

• Process, store, and display Your Content solely to provide AI editing services

• Retain copies temporarily for troubleshooting, abuse prevention, and legal compliance

This license ends when you delete Your Content or request deletion from our servers.

AI-Generated Outputs

• Ownership: You own outputs generated from Your Content, subject to these Terms

• No guarantees: Outputs are AI-generated and may contain artifacts, inaccuracies, or unexpected results. We make no warranties about quality, accuracy, or fitness for any purpose

• Your responsibility: You are solely responsible for how you use, distribute, or rely on AI outputs. You must:
- Obtain necessary rights and consents for input images (especially images of real people)
- Comply with all applicable laws
- Not use outputs to defame, deceive, or harm others

Prohibited Uses of AI Outputs

You may not use the App or outputs to:

• Create non-consensual intimate imagery or deepfakes

• Impersonate real individuals without consent and clear labeling

• Generate illegal content (child sexual abuse material, extreme violence, hate speech, etc.)

• Violate intellectual property rights (e.g., edit copyrighted images you don't own)

• Mislead others (e.g., pass off synthetic images as real without disclosure)

5. User-Generated Content and Takedown

Rules

Your Content must comply with our Acceptable Use Policy. Prohibited content includes:

• Illegal material (child exploitation, terrorism, human trafficking)

• Non-consensual intimate images

• Hate speech, harassment, or incitement to violence

• Intellectual property infringement

• Biometric impersonation without consent

Reporting Violations

To report prohibited content or copyright infringement:

Email contact@secretcode.ro with:
- Description of the violation
- Your contact information
- For copyright claims: proof of ownership

Our Response

We will:

• Investigate reports within 5 business days

• Remove violating content and may suspend or terminate access

• Cooperate with law enforcement where legally required

6. In-App Purchases

Payment

• Purchases are processed by Apple via In-App Purchase (IAP)

• We do not store your payment card details

• All purchases are one-time (no auto-renewing subscriptions at this time)

Restore Purchases

If you reinstall the App or use a new device:

1. Open the App
2. Go to Settings → Restore Purchases
3. Sign in with the same Apple ID used for the original purchase

Your non-consumable purchases will be restored automatically.

Refunds

• Refunds are managed by Apple, not us

• To request a refund: Visit Apple Support or your purchase history in the App Store

• We cannot issue refunds directly

7. Account Deletion

You can delete your account and all associated data at any time directly from the App:

1. Go to Profile (Settings)
2. Scroll to the bottom
3. Tap "Delete Account"
4. Confirm your choice

Deleting your account is permanent and irreversible. All your data will be permanently deleted, including:

• Profile information
• All generated images (from gallery)
• Generation history
• Credits balance
• Purchase history

This feature complies with Apple App Store Review Guidelines 5.1.1 (Account Deletion).

8. Disclaimers and Limitation of Liability

No Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

• Merchantability or fitness for a particular purpose

• Accuracy, reliability, or quality of AI outputs

• Uninterrupted, error-free, or secure operation

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, consequential, or punitive damages (lost profits, data loss, reputational harm, etc.)

• Our total liability for any claim is limited to the amount you paid us in the past 12 months (or $50 USD if no payment was made)

This does not limit liability for death/personal injury caused by negligence or fraud.

9. Termination

We may suspend or terminate your access if you:

• Violate these Terms or the Acceptable Use Policy

• Engage in illegal activity or abuse

• Attempt to harm the App or other users

You may stop using the App anytime by deleting it.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with Romanian law, without regard to conflict of law principles.

Any disputes arising from these Terms or the App will be resolved through good faith negotiation or, if necessary, in the competent courts of Romania.

11. Changes to Terms

We may update these Terms. Changes take effect when posted with a new Effective Date. We'll notify you via in-app message or the updated date above. Continued use means acceptance.
